Technical Guidance on Procedures for Imposing Light Disciplinary Punishments on Civil Servants

Tuesday, 05/17/2022. Secretary of the East Kalimantan Provincial Bappeda, Mrs. Charmarijaty, ST, M.Si was present at the implementation of the "Technical Guidance on Procedures for Imposing Light Disciplinary Punishments on Civil Servants" organized by the Regional Civil Service Agency of East Kalimantan Province at the Jatra Balikpapan Hotel.

At the event which was attended by representatives of all Regional Apparatus within the East Kalimantan Provincial Government, present as a resource person in the technical guidance activity was Mr. Sutarwo, Head of Civil Service Subdivision and ASN Discipline of the East Kalimantan Provincial Civil Service Agency .

Several important things that can be summarized in the implementation of this technical guidance include

(1) The basic regulations that form the basis for civil servant discipline are Government Regulation (PP) No. 94 of 2021 concerning civil servant discipline.

(2) BKN Regulation No.21 of 2010 has been revoked and does not apply, furthermore use BKN Regulation No.6 of 2022 concerning Perlak PP No.94 of 2021.

(3) The definition of a disciplinary violation is any speech, writing or action of a civil servant that does not comply with obligations and/or violates the prohibitions on civil servant disciplinary provisions, whether committed inside or outside working hours.

(4) Forms of light disciplinary punishment can be in the form of a verbal warning (for civil servants who are absent from work without valid reasons cumulatively for 3 working days in 1 year), a written warning (for civil servants who are absent from work without valid reasons cumulatively for 4-6 working days in 1 year), as well as written statements of dissatisfaction (for civil servants who are absent from work without valid reasons cumulatively for 7-10 working days in 1 year).< /p>

(5) Officials who have the authority to punish are the President, Civil Service Development Officer, Head of Representative of the Republic of Indonesia, Middle High Leadership Officials or other equivalent officials, Primary High Leadership Officials or other equivalent officials , Administrator Officer or other equivalent official, Supervisory Officer or other equivalent official.

(6) Currently, officials/direct superiors can impose punishments on staff who are directly under them.
